Module Description: This module is designed to provide the student with a comprehensive understanding of the functions and practices of Franchised Dealer Operations within the Motor Industry.
Learning Outcomes
On successful completion of this module the learner will be able to:
LO1 Discuss the rules associated with data protection and their relevance to departmental activities within the Motor Trade.
LO2 Explain the obligations placed on the operators of vehicle franchised networks by Block Exemption regulations.
LO3 Describe the obligations placed on the franchise dealer management and the functions of the management team.
LO4 Discuss the various types of insurance cover required within the Motor Industry.
LO5 Outline the current legislation and responsibilities for the control and handling of hazardous material and waste management.

Indicative Content
Data protection act
Scope of the Act. Duties and responsibilities of the Data Processor, Data Controller.Enforcement; legal powers, offences and penalties, codes of practice. Rights of Data subject. Effective database control.
Block exemption regulations
Rules regarding the supply,distribution and after-sales duties in relation to new vehicles.Review of dealer contracts.Impact on Customers. Framework for the operation of vehicle franchised networks. Single marque showrooms, multi brand showrooms, vehicle allocation, dealer territories etc. Rules regarding the availability of technical information and equipment to independant repairers.
Managing the business
Management functions. Aims objectives and policy. Work practices and operations. Managing employees, training and customer care.
Legal duties of seller and repairer
Extent of Sales of Goods and Supply of Services Act. Contract of Repair.
Environmental and social policy
Effective waste management in relation to the motor industry. Responsibilities of the consignor, consignee, and carrier. Storage and use of dangerous substances.
Insurance
Various insurances required in the motor industry, public liability, material damage, product liability consequential loss and social insurance.
Safety and health
Responsibilities of employers and employees. Safety statement, safety officer, risk assessment.
